Donatas Murauskas, Head of Division for the Representation before the European Court of Human Rights
Donatas Murauskas is heading the Division for the Representation before the European Court of Human Rights at the Ministry of Justice of the Republic of Lithuania. He is also a lecturer at Vilnius University Faculty of Law (Lithuania). He has acquired his MA in law from Vilnius University and LL.M in Law and Economics from European Master in Law and Economics (EMLE) programme. D. Murauskas has defended his PhD thesis in law at Vilnius University Faculty of Law in 2015. He has held scholarships at Charlotte School of Law and Erasmus University Rotterdam, and has taken part in a number of national and international research events. Main areas of interest: human rights law; law & economics; legal argumentation of national and supranational courts.
Presentation “Mental health in the case-law of the European Court of Human Rights”
The presentation will be structured as follows. First, the recent cases of the European Court of Human Rights in the areas related to protection of human rights of persons suffering from mental health issues, including the scope of obligation to provide appropriate medical care, will be presented. Second, the presentation will focus on the analysis of the judgment D.D. v. Lithuania concerning the deprivation of liberty of the applicant, who suffered from schizophrenia, however, was still able to express an opinion on her situation. This case was one of the major factors determining the reform on the restriction of legal capacity of a person in Lithuania, which will be discussed during the presentation.
